Privacy policy
This is an English translation for your convenience. The German version (Datenschutzerklärung) is legally binding.
1. Controller
The controller within the meaning of the General Data Protection Regulation (GDPR) and other data protection provisions is:
Oliver Kalz e.K.
Wanninchener Str. 8
15926 Luckau, OT Görlsdorf
Germany
Phone: +49 (0)3544 555851
E-mail: verkauf@wohnzelle.de
2. General information on data processing
As a rule, we only process personal data of our visitors to the extent necessary to provide a functioning website and to handle enquiries. This website does not use cookies or social media plug-ins. Only if you expressly choose so does it place an entry in your browser's storage (see section 7). Data is transmitted in encrypted form via HTTPS/TLS.
3. Hosting and server log files
This website is hosted by Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, USA ("Netlify"). When you access the website, Netlify automatically records information transmitted by your browser in so-called server log files: IP address, date and time of access, page accessed, browser type and version, operating system and referrer URL. This data serves to ensure technical operation and to defend against attacks (legal basis: Art. 6(1)(f) GDPR, legitimate interest in providing the website securely).
A data processing agreement is in place with Netlify. Where data is transferred to the USA, this is based on the EU Standard Contractual Clauses. Further information: www.netlify.com/privacy.
4. Contact form and getting in touch
If you contact us via the contact form, by e-mail or by phone, we process the data you provide (name, e-mail address, optionally phone number and the content of your message) solely to handle your enquiry and any follow-up questions (legal basis: Art. 6(1)(b) GDPR, pre-contractual measures, or Art. 6(1)(a) GDPR, consent). This data is not passed on to third parties.
Form entries are technically received by the form function of our hosting provider Netlify and forwarded to us. The information on data processing given in section 3 applies.
5. PDF brochure "Wohnzelle compact"
You can download our free PDF brochure directly on the home page and in the hint shown on some pages, without entering any data. If you would rather have it sent to you by e-mail, we collect your e-mail address via the form (required for sending) and, if you provide it, your first name for addressing you. In addition, the language of the page (so that we send you the matching version of the brochure) and your confirmation of this privacy information are transmitted.
We use this information exclusively to send you the brochure by e-mail, usually within one business day, from our mailbox verkauf@wohnzelle.de. Beyond that, we do not write to you on our own initiative, neither with advertising nor with a newsletter. Only if you contact us yourself do we process your information as described in section 4.
The legal basis is your consent (Art. 6(1)(a) GDPR), which you give by ticking the box in the form. You can withdraw it at any time with effect for the future, for example by e-mail to verkauf@wohnzelle.de; we will then delete your information. Form entries are received by our hosting provider Netlify and forwarded to us (see section 3). They are not passed on to any other third parties. Once your request has been dealt with, we delete it together with the related e-mail correspondence in our next monthly deletion run, and no later than six months after receipt; any further contact arising from it is governed by section 4.
6. Audience measurement with Plausible
Audience measurement with Plausible. We use Plausible Analytics (Plausible Insights OÜ, Estonia, EU hosting) to evaluate the use of this website statistically. Plausible does not use cookies and does not store personal profiles; IP addresses are not stored permanently. The legal basis is our legitimate interest in improving our offering (Art. 6(1)(f) GDPR).
7. Storage in your browser (local storage)
Our hint about the free PDF brochure contains the button "Hide for 30 days". Only if you choose it does this website store an entry in your browser's local storage with the status "hidden" and the time of your choice. This tells us that the hint should not appear again for 30 days. If you merely close the hint (× or the Escape key), download the brochure, request it by e-mail or do not use the hint at all, nothing is stored.
No identifiers are stored; the entry remains in your browser and is not transmitted to us or to third parties. Once the period has expired or if the entry is invalid, the website deletes it the next time you open a page that includes the hint. It also removes entries created by earlier versions of this hint. You can delete the entry at any time via your browser settings.
The legal basis is Section 25(2) no. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG): the storage is strictly necessary so that the hint remains hidden for 30 days, as you have expressly chosen. We use Plausible (section 6) to count, without cookies, how often the hint is shown, used for downloading or for requesting the brochure by e-mail, closed or hidden; the entry in your browser is not transmitted in the process.
8. Storage period and routine deletion
We process and store personal data only for the period required to achieve the purpose of storage, or where statutory retention periods apply. If the purpose of storage no longer applies or a prescribed storage period expires, the personal data is routinely blocked or deleted in accordance with the statutory provisions.
9. Your rights as a data subject
Under the GDPR you have the following rights:
- Right to confirmation and access to the data processed (Art. 15 GDPR)
- Right to rectification of inaccurate data (Art. 16 GDPR)
- Right to erasure ("right to be forgotten", Art. 17 GDPR)
- Right to restriction of processing (Art. 18 GDPR)
- Right to data portability (Art. 20 GDPR)
- Right to object to processing (Art. 21 GDPR)
- Right to withdraw consent given with effect for the future (Art. 7(3) GDPR)
- Right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR)
To exercise your rights, an informal message to verkauf@wohnzelle.de is sufficient.
10. Provision of data
The provision of personal data is neither required by law nor by contract and is not necessary for visiting this website. However, for an enquiry via the contact form and for having the PDF brochure sent by e-mail, the fields marked as required must be completed; you can download the brochure without providing any data. No automated decision-making or profiling takes place.
